Illustro Institutional Repository Deposit Agreement

In order to deposit any material in the IADT Illustro Institutional Repository, Depositors must agree to the following:

Covered Work:

I wish to deposit my material in the IADT Illustro Institutional Repository.  Research referred to below as "Work" is covered by this agreement and when I deposit my Work, whether personally or through an assistant or other agent, I agree to the following:

Non-Exclusive Rights

Rights granted to the Illustro Repository through this agreement are entirely non-exclusive.  I am free to publish the Work in its present version or future versions elsewhere. I agree that IADT may electronically store, copy or translate the Work to any medium or format for the purpose of future preservation and accessibility.  IADT is not under any obligation to reproduce or display the Work in the same formats or resolutions in which it was originally deposited.

Deposit in IADT Illustro Institutional Repository

I understand that Work deposited in the digital repository will be accessible to a wide variety of people and institutions

- including automated agents

- via the World Wide Web I understand that once the work is deposited, metadata will be incorporated into public access catalogues. This citation to the Work will always remain visible, although the author retains the right to update the Work.  Removal of the item can be made after discussion with the Library Repository team.

I AGREE AS FOLLOWS:

1. I have the authority of the author(s) to make this agreement and to hereby give IADT the right to make available the Work in the way described above.

2. IADT has the right to store, display and publish the Work deposited on open access to the WWW for non-commercial purposes only and subject to the Creative Commons License.

3. Items may only be deposited by IADT Faculty, staff members or students.  Files should be submitted to the libraryrepository@iadt.ie email address and will managed accordingly.

4. That I have exercised reasonable care to ensure that the Work is original, and does not to the best of my knowledge breach any laws including defamation, libel and copyright.

5. Confidential data or data that would breach agreements with third-parties should not be included.  If specific publishers or funders' embargos are in place, these need to be highlighted so that only the metadata appears until after the embargo period.

6. The validity and authenticity of the content of submissions is the sole responsibility of the depositor.

7. By depositing content through this process, Depositors indemnify IADT and Figshare in respect of any and all claims for copyright infringement and/ or any other infringement.

8. IADT has the right to preserve the Work to ensure its availability, regardless of technology changes.

9. IADT will provide metadata of the Work to public access catalogues.

10. The Work must not contain any extra security settings and must be the final corrected version of a thesis or the un-copyrighted version of an article, book, or book chapter.

11. IADT does not hold any obligation to take legal action on behalf of the Depositor, or other rights holders, in the event of breach of intellectual property rights, or any other right, in the material deposited.

12. IADT is permitted to share usage statistics detailing the number of downloads, views or other relevant statistics.

13. IADT will not be liable for any loss or damage to the Work while it is stored in the Repository.

14.  All material in the Repository will be licensed under a Creative Commons Attribution-NonCommercial-NoDerivs CC BY-NC-ND by default (see here for further information).  Authors or collection administrators may apply other Creative Commons Licenses as appropriate to collections or individual submissions.  The Author in consultation with Institute Librarian will have the final authority to decide which license is applied.

15. All objects in the Repository will receive a document Handle ID or Digital Object Identifier (DOI) as relevant, which will provide persistent access to the item.
